Is Mediation A Good Option For Your Divorce?
You are no longer in love with your spouse and, as far as you are concerned, the marriage is over. Now you just have to figure out how to make it official. The truth is, you have options, one of which is divorce mediation. Without question, it is not for everyone, but for some couples who are ending their marriages, it can be the ticket.
Mediation: the Advantages
If staying clear of a courtroom is one goal in your divorce, mediation could be just what you’re looking for. A neutral mediator guides negotiations as you and your spouse come up with a settlement agreement that works for you both. The advantages to this strategy are clear:
1- It won’t hit your pocketbook to the same extent that a traditional divorce could. Chances are you and your spouse will split the cost of the mediator, which is generally cheaper than court proceedings are.
2- The process is quicker. Since you don’t have to worry about the court’s schedule, the planning and negotiation conferences can occur without delay, as soon as you are ready.
3- It can empower you to make positive choices. Because you are participating in voluntary discussions, it becomes easier to make concessions and come to agreements where both individuals are satisfied with the outcome.
4- It is more informal and therefore less stressful. In general, those involved in mediation find that they are more at ease as they proceed through what can otherwise be a stressful situation.
It’s Not for Everyone
There are some situations in which mediation is not likely to be successful. If one person is hiding assets, or if settling on a time-sharing plan is going to be out of reach without a judge’s intervention, you may as well skip mediation and both of you get your own attorneys so you can fight it all out in court. Divorce always involves myriad decisions, from small to large. If you’re dealing with a partner who is tremendously angry, dishonest, or manipulative, it’s going to be tough to come to agreement on the simplest of problems, let alone the tough issues. But even if your spouse is committed to the process and willing to compromise, some divorces have such complex issues to address, such as business ownership, extensive assets, or even mental health problems, that mediation may not lead to the solutions you’re looking for and might just prolong the inevitable—divorce court– adding to the expense and time involved in the whole ordeal. Mediation is a great option in situations where couples agree to the divorce and are willing to set aside their emotions in order to work out an equitable settlement. But complicated settlements can be better addressed through traditional divorce.
