When You Want a Quick Divorce

For anyone looking for a quick and simple divorce, you may be pleased to know that the process can be fairly swift under certain circumstances. Typically a divorce can range anywhere from a few months to a few years. What can you do to speed up the process?

Uncontested Divorces Move More Quickly 

Obviously, when a divorce is contentious, it tends to plod along as lawyers and/or mediators trudge through disagreements, trying to find a compromise that will suit both parties. Those situations often involve additional issues around the possibility of one spouse hiding assets, one spouse resisting shared custody, or serious conflicts related to the division of property. When couples agree to all aspects of the split, they can present their own plan for the terms of the divorce, and there won’t be hearing after hearing to get things done. The requirements are pretty simple:

  • One or both of you need to have resided in Florida for six or more months prior to filing for divorce;
  • You must agree on the grounds for divorce—usually that your marriage is unsalvageable;
  • You must have determined how to divide property and real estate;
  • There must be an agreement as to who takes on what debt;
  • If you have minor children, you must agree on a parenting plan including custody and visitation, as well as child support.

 Simplified Dissolution 

For couples who have not been married for very long and who have no minor dependents to worry about, a Petition for Simplified Dissolution may be an option. Couples would have to agree to property dispensation and then avoid all of the hassles and complexities of a typical divorce. Many couples find they can actually be finished with the whole thing within just a month. If there are concerns related to any of the issues related to the split, that time will be extended to accommodate additional hearings.

If Domestic Violence is an Issue 

For situations in which domestic violence has been a problem, there’s no real way to speed up the process.  However, the court will be concerned about the violence, especially if children are present.  Although finalizing your divorce may take some time, getting a restraining order, financial support, and the possibility of a bigger share of the marital property could make the wait more tenable.
